It is only a state office (not Congress) but a Democratic candidate running for the state legislature appears to have lost the election to a dead man!

The governor's office claims that the Governor has the right to appoint someone to the seat because the ND constitution says that in the event that there is no other process in place for replacing a vacancy that the Governor can make the appointment. Apparently if the man had died after the election, the ND GOP would be able to decide who would be appointed but the Governor's office is basing their claim on the fact that the ND constitution says that a candidate must be eligible on election day and that since he was dead he was not eligible therefore they claim that the GOP cannot make the appointment.

I suspect that this is going to be a court case.
